Safety Management Systems (SMS)

Transport Canada’s Marine Safety Management System Regulations (MSMSR) (SOR/2024‑133) came into force on July 3, 2024, and will soon require most commercial vessels to have a documented Safety Management System (SMS) in place.

The regulations apply to a wide range of Canadian commercial vessels, including most:

  • Passenger vessels
  • Towboats
  • Workboats
  • Cargo vessels

Vessels are grouped by class (1 to 5), and compliance deadlines vary based on class and certificate anniversaries. Key dates include:

  • By July 3, 2025: Most passenger vessels (Class 2–4) must comply
  • By July 2, 2026–2027: Remaining Class 2–5 vessels must comply on the anniversary of their inspection or registry certificate

Exemptions include pleasure craft, fishing vessels under 24.4 m, and non-propelled or human-powered vessels.

What Is Required?

Affected vessels must:

  • Develop and maintain a Safety Management System (SMS), including safety policies, procedures, emergency preparedness, and internal audits
  • Obtain a Document of Compliance (DOC) and Safety Management Certificate (SMC) from Transport Canada or a Recognized Organization, dependent on DSIP status
  • Implement the SMS onboard within six months of certification
  • Conduct regular reviews and audits to remain in compliance

Failure to comply can result in fines, detentions, or loss of certification.
